Terms of service

You must be at least 18 years old to create an account. Keep your credentials private and tell us promptly if you believe your account has been used without permission. You are responsible for activity under your account.

A care space is created by an owner to organize care for one person. The owner controls membership, billing, export, and deletion. When you invite someone, you are choosing to share that person's information with them at the role you select, and you confirm you have the right to do so.

• Where the care recipient can make their own decisions, obtain their agreement before sharing their information.
• Review your Care Circle regularly and remove people who no longer need access.
• Removed members lose access immediately, but information they already saw cannot be recalled.
• Only share an Emergency Profile link with people who need it, and revoke links you no longer use.

• Do not use the service unlawfully, or to harass, surveil, or control another person.
• Do not upload information you have no right to share.
• Do not attempt to access another care space, bypass permissions or entitlement checks, or probe the service's security without written permission.
• Do not resell the service, or use it to provide regulated clinical services.
• Do not upload malicious files or interfere with the service's operation.

We may suspend or end access that breaks these rules or puts other people at risk.

You keep ownership of the records and documents you add. You grant us the limited permission needed to store, process, display, and transmit them so we can operate the features you use, including AI features you invoke.

Essential is free. Family costs $9.99/month or $99/year, charged through Stripe to the payment method you provide. Only the owner of a care space can start, change, or cancel a subscription.

• Existing records are not deleted after cancellation.
• Paid features remain available through the paid subscription period.
• Subscriptions can be managed or canceled at any time through the billing portal.
• No hidden setup fee.

Subscriptions renew automatically at the end of each billing period until canceled. If a payment fails, paid features stay available for a short grace period while the payment is retried, after which the care space returns to Essential. Except where the law requires otherwise, payments are not refundable for a period already begun. Prices may change with advance notice; changes apply from your next renewal.

EldersCare AI organizes information. It does not diagnose, prescribe, monitor health continuously, or replace licensed medical care, and it is not an emergency response service. Reminders and notifications depend on devices, networks, and email providers we do not control. We do not guarantee that any reminder will be delivered or seen.

We may change, add, or remove features, and the service may be unavailable at times for maintenance or reasons outside our control. We aim to give notice of significant changes.

To the fullest extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure against every threat, or that information in it is complete or accurate.

To the fullest extent permitted by law, Scarano Business Solutions LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or any health outcome, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

You agree to indemnify Scarano Business Solutions LLC against claims arising from your misuse of the service, from information you shared without the right to share it, or from your breach of these terms.

You may stop using the service and delete your care space at any time. We may end access for a serious or repeated breach of these terms, with notice where practical.

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Questions go to support@elderscare.ai.
